Holiday Pay for Former Employees Working Term Time Only
This is notification that the calculation for holiday entitlement for Schoolsworks Trust employees on term time only contracts has changed.
The change made relates to how the statutory minimum 5.6 weeks paid annual holiday entitlement is calculated for part-year workers. As a Trust, we mirror the West Sussex Local Authority calculation for term- time only employees and calculate the paid annual holiday entitlement on a pro-rata basis to that of a year-round worker.
Following a ruling of the Supreme Court, some term time only employees may have received paid holiday that is less than the statutory minimum 5.6 weeks provided for in the Working Time Regulations (WTR). The employees affected by this are those on grades 1-7, working 38, 39 or 40 weeks per year and with less than 5 years of continuous local government service, who have received payment for between 5.2 weeks (26 days) and 5.4 weeks (27 days) holiday per annum.
If you are a former employee and believe you may have been affected by this ruling, please contact hr@schoolsworks.org.
